Derma.pk Affiliate Program Terms of Service

Introduction #

Welcome to the Derma.pk Affiliate Program! We’re excited to partner with you to promote our high-quality skincare products. Before you get started, please carefully review the following Terms of Service (“Agreement”). By participating in the Program, you agree to be bound by these terms and conditions.

1. Definitions #

To ensure clarity, here are some key terms used throughout this Agreement:

• Affiliate: An individual or entity approved to participate in the Program.
• Affiliate Link: A unique URL provided to you that tracks referrals to Derma.pk.
• Commission: A percentage of the sale price paid to you for each successful referral.
• Customer: A visitor to Derma.pk who makes a purchase through an Affiliate Link.
• Dashboard: The online interface provided to you to track your performance and earnings.
• Marketing Materials: Promotional materials provided by Derma.pk, including banners, product images, and videos.
• Net Sales: The total revenue generated from sales made through Affiliate Links, excluding shipping costs, taxes, and returns.
• Website: The Derma.pk website located at https://derma.pk.

2. Your Responsibilities as an Affiliate #

• Accurate Information: Provide accurate and complete information during the registration process.
• Promotional Activities: Promote Derma.pk in a professional and ethical manner, complying with all applicable laws and regulations.
• Content Guidelines: Ensure that all promotional content is accurate, truthful, and not misleading.
• Brand Guidelines: Adhere to Derma.pk’s brand guidelines when using our logo or trademarks. You may create your own marketing materials, but all promotional content must include the Derma.pk logo.
• Prohibited Activities: Refrain from engaging in any activity that may damage the reputation of Derma.pk.

3. Earning Commissions #

• Commission Structure: You earn a commission on Net Sales generated through your Affiliate Links. We have a tiered commission structure to reward your performance:
  • Bronze: 5% commission
  • Silver: 7% commission (after 50 sales)
  • Gold: 10% commission (after 100 sales and Rs. 250,000 in revenue)
• Commission Payments: Commissions are paid monthly, provided you have earned a minimum of [insert minimum payout amount].
• Payment Method: Commissions are paid via bank transfer to your designated bank account.

4. Tracking and Payment #

• Tracking Technology: Derma.pk uses cookies and other tracking technologies to track referrals and attribute sales to you.
• Payment Processing: Derma.pk will make reasonable efforts to process commission payments promptly and accurately.
• Payment Disputes: Any discrepancies in commission payments must be reported to Derma.pk within [insert timeframe] of the payment date.

5. Intellectual Property #

• Ownership: All intellectual property rights in the Website, Marketing Materials, and Derma.pk’s brand assets remain the property of Derma.pk.
• Limited License: You are granted a limited, non-exclusive license to use Marketing Materials for the sole purpose of promoting Derma.pk.

6. Termination #

• Termination by Either Party: This Agreement may be terminated by either party for any reason with [insert notice period] written notice.
• Termination for Breach: Derma.pk may terminate this Agreement immediately if you breach any provision of this Agreement.
• Effect of Termination: Upon termination, you must cease all promotional activities and remove all Derma.pk branding and links from your website and social media platforms.

7. Disclaimer and Limitation of Liability #

• No Warranties: Derma.pk makes no warranties, express or implied, regarding the Program or the Website.
• Limitation of Liability: Derma.pk shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to this Agreement.  

8. Confidentiality #

• Confidential Information: Both parties agree to keep confidential any information disclosed by the other party during the course of this Agreement.

9. Governing Law and Dispute Resolution #

• Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Pakistan.  
• Dispute Resolution: Any dispute arising out of or relating to this Agreement shall be settled amicably between the parties. If an amicable settlement cannot be reached, the dispute shall be referred to arbitration in accordance with the Arbitration Act, 1940 of Pakistan.

10. Entire Agreement #

• Complete Agreement: This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
